CONSTRUCTION

Owners, engineers, EPC contractors, general contractors, construction managers, design-build contractors, lenders, sureties, subcontractors and suppliers consistently retain Fahl & Donaldson for guidance and representation through all phases of a construction project. We represent clients in the design and construction industries, from project planning through resolution of complex construction disputes. Our experience spans a broad spectrum of projects and industries, including commercial buildings, municipal buildings and facilities, public works projects, roads & highway projects, power plants and power transmission facilities, energy projects (upstream, midstream and downstream), industrial facilities, maritime structures, health care facilities, schools, sports facilities, hotels, parking structures and residential developments.

Certain issues arise again and again in construction, often leading to schedule erosion and cost overruns. We routinely defend and prosecute delay and disruption claims, extra and additional work claims, unanticipated site condition claims, and payment claims (including mechanic's and materialmens’ liens, performance bond claims and payment bond claims). We have significant experience in construction defect cases alleging patent or latent defects due to defective work, defective materials, and defective design. We have advised and represented clients in all types of legal forums, including state and federal courts, administrative hearings, mediations, and arbitrations. We pursue favorable resolutions in our clients' best interests and proactively advocate on their behalf throughout the course of construction projects and dispute resolution process.

Representative Work

Jury Trials: Representation of a contractor on industrial project in Jefferson, County, Texas, asserting claims against the engineer for delay, disruption, interference, additional and extra work (jury verdict in excess of $1.2 million in favor of our client); representation of an industrial sandblasting and coating contractor against coating manufacturer for delay damages and extra work due to defective coating on a chemical plant project in south Texas (jury verdict in favor of client); representation of an owner of custom home in defective work claim against homebuilder in Hardin County, Texas (jury verdict in favor of client for both actual and punitive damages); and defense of industrial contractor accused of violating the Americans With Disabilities Act in the United States District Court for the Eastern District of Texas (jury verdict in favor of client).

Representation of a regional plumbing supplier in U.S. Bankruptcy Court for the Eastern District of Texas in the first case interpreting the Texas Construction Trust Fund Statute under the fraud provisions in the U.S. Bankruptcy Code (concluded in the Fifth Circuit Federal Court of Appeals).

Arbitrations: Representation of the owner of a medical facility against an architect for defective design that resulted in severe structural damage (award in favor of the client); representation of the owner of a custom home project against the homebuilder and multiple subcontractors for defective work that resulted in water intrusion (award in favor of client);

Federal Administrative Hearings: Representation of a contractor on a project at Carswell AFB pursuing claims for extra and additional work, cardinal change and schedule impact (decision in favor of client).

Work Outs: Representation of a lender in a workout with the design-build contractor who defaulted on a large church project in Houston; representation of a chemical company in an interpleader action seeking resolution of competing claims for payment from the general contractor and several subcontractors who filed multiple mechanics and materialmen’s liens (project successfully closed out); representation of the owner in a workout with a general contractor who defaulted on multiple church projects in Harris County, Texas; represented a highway contractor pursuing claims for delay and disruption against Texas DOT caused by the U.S. Army Corp of Engineers; and defended a contractor on a U.S. Coast Guard Project against delay and liquidated damages claims.

Project Development. We have provided legal services as the project is developed during the design and procurement phases, including: drafting the detailed engineering and design contract for $2.2 billion offshore energy project in St John’s, Newfoundland; construction contract review for the lender on a commercial multi-use development; engineering services agreements for maintenance and construction of nuclear power plants in several states; a design-build contract for an energy-related manufacturing and fabrication plant; owner-contractor agreements (cost of the work plus a fee with a guaranteed maximum) for construction of several new churches for a Catholic archdiocese; design-build contract for new $20 million corporate campus for an oil exploration company; master services agreement for procurement of fabricated steel components for a refinery project; subcontract agreement with an EPC contractor to construct blast-proof control rooms in a new chemical plant; owner-contractor agreements for a school district utilizing design-build and construction management procurement methods; energy savings performance contracts for a public school district; and owner-architect and owner-contractor agreements for the design and construction of a $3.8 million custom home.

Surety Bonds. Represented sureties in performance bond claims after the default of the general contractor, including issues that arise in the completion of the project, payment bond claims from subcontractors and suppliers, and pursuing claims that arise in favor of the defaulting general contractor. Managed payment bond claims arising on private projects, state public works projects and federal projects, including perfection, priority, and of course analyzing the validity of the claim.
